City of Cortland adopts Cannabis Dispensary Act

The Cortland Common Council unanimously voted in favor of an enacted local law, known as the Cannabis Dispensary Act, that regulates cannabis-based retail dispensaries and cannabis-related products to General Business District-1 zoning in the city at its meeting on Tuesday.

In March of last year, New York state legalized the recreational use of marijuana for adults 21 or older. The state also gave municipalities the opportunity to allow marijuana retail sales and on-site consumption establishments in their respective areas.

The zoning change to GB-1 amends to add “Head Shops” for cannabis-based businesses. 

According to the dialogue of the local law, a “Head Shop” is a:

A retail establishment that offers for sale, use or display paraphernalia or items designated or marketed for use with tobacco products, inhalants commonly referred to as “vaping products” and inclusive of e-cigarettes, marijuana, or controlled substances; a cannabis dispensary, or anything similar in use.

The GB-1 zoning district where “Heads Shops” are permitted will run alongside the Interstate-81 corridor on River Street to Port Watson Street in the city. City mayor Scott Steve at Tuesday’s meeting confirmed the exact location of the GB-1 zoning district where cannabis-related businesses are permitted. According to the local law, “Head Shops” are prohibited in other districts in the city.
