Proclamations/Presentations

Proclamation #1 - Honoring Sgt. Jake Garrett for Life Saving Actions

  • WHEREAS, Sgt. Jake Garrett has been the Noncommissioned Officer in Charge (NCOIC) of the Cortland Marine Corps recruiting office for almost three years; AND
  • WHEREAS, he has been an active member of Cortland County Marine Corps League Detachment #221, assisting with burial details, honor guards, color guards, and Toys for Tots campaign; AND
  • WHEREAS, Sgt. Garrett is invested in the community and demonstrated that the night of August 19, 2019, when working his usual long and late hours stepped out front of the recruiting when he witnessed an altercation between two men; AND
  • WHEREAS, when it escalated into a stabbing, Sgt. Garrett reacted in true Marine Corps fashion, stopping the attack, and performing first aid, covering the cuts and applying pressure to the victim’s wounds while not realizing he had been stabbed in the process; AND
  • WHEREAS, law enforcement, EMTs and fire fighters stated he more than likely saved the victims life; NOW, THEREFORE, BE IT
  • RESOLVED, that the City of Cortland does hereby recognize and honor Sgt. Jake Garrett for his quick and brave actions on the night of August 19, 2019 which stopped a violent attack, saved the victim from further harm and rendered lifesaving aid; AND BE IT FURTHER
  • RESOLVED, that the City of Cortland thanks Sgt. Garrett for his years of service to the community and wishes him well in his future endeavors.

Agenda Item #1 - Approve Special Event and Related Permits for Juneteenth Festival

  • WHEREAS, Juneteenth Festival organizers have submitted a Special Event Application for the purposes of holding a festival in Courthouse Park on June 18, 2022; AND
  • WHEREAS, organizers have submitted a Sound Device Permit Application for the event; AND
  • WHEREAS, organizers have submitted an Operating Permit Application for an occupant load of more than 100 persons; AND
  • WHEREAS, the Police Department, Fire Department and City Clerk’s Office have reviewed applicable aspects of these permit applications and recommended their approval; NOW, THEREFORE, BE IT
  • RESOLVED, that the Common Council does hereby approve a Special Event Permit, a Sound Device Permit without fee, and an Operating Permit for the Juneteenth Festival to be held on June 18, 2022.

Agenda Item #2 - Approve Special Event and Related Permits for Cortland LGBTQ Pride Festival

  • WHEREAS, Cortland LGBTQ Pride Festival organizers have submitted a Special Event Application for the purposes of holding a festival in Courthouse Park from Noon to 3:00 p.m. on June 26, 2022; AND
  • WHEREAS, organizers have submitted a Sound Device Permit Application to host a DJ during the event; AND
  • WHEREAS, organizers have submitted an Operating Permit Application for an occupant load of more than 100 persons; AND
  • WHEREAS, the Police Department, Fire Department and City Clerk’s Office have reviewed applicable aspects of these permit applications and recommended their approval; NOW, THEREFORE, BE IT
  • RESOLVED, that the Common Council does hereby approve a Special Event Permit, a Sound Device Permit without fee, and an Operating Permit for the Cortland LGBTQ Pride Festival to be held from Noon to 3:00 p.m. on June 26, 2022.

Agenda Item #3 - Approve Special Event and Related Permits for Arts Off Main

  • WHEREAS, Cortland Arts Connect has submitted a Special Event Application for the purposes of holding the Arts Off Main festival in parking lots on Central Ave. from 10 a.m. to 4:00 p.m. on August 6, 2022; AND
  • WHEREAS, organizers have submitted a Sound Device Permit Application; AND
  • WHEREAS, organizers have submitted an Operating Permit Application for an occupant load of more than 100 persons; AND
  • WHEREAS, the Police Department, Fire Department and City Clerk’s Office have reviewed applicable aspects of these permit applications and recommended their approval; NOW, THEREFORE, BE IT
  • RESOLVED, that the Common Council does hereby approve a Special Event Permit, a Sound Device Permit without fee, and an Operating Permit for the Arts Off Main Festival to be held from 10:00 a.m. to 4:00 p.m. on August 6, 2022.

Agenda Item #4 - Cancel June 7, 2022 Common Council Meeting

  • WHEREAS, the Common Council is scheduled to meet at 6:00 p.m. on June 7, 2022; AND
  • WHEREAS, the Cortland County Dairy Parade is being held on the evening of June 7, 2022; AND
  • WHEREAS, it is traditional for the Mayor and Common Council members to participate in the Dairy Parade and/or show their support for the dairy industry by attending the parade; NOW, THEREFORE, BE IT
  • RESOLVED, that the Common Council does hereby cancel its meeting scheduled for June 7, 2022 so that the Mayor and members of the Common Council may participate in the Dairy Parade and/or show their support for the dairy industry by attending the parade.

Agenda Item #5 - Appoint Member to Cortland Housing Authority Board

  • WHEREAS, Merle McKown is a member of the Cortland Housing Authority Board with a term expiring May 31, 2022; AND
  • WHEREAS, Mrs. McKown has been recommended for reappointment by the Cortland Housing Authority and has agreed to be reappointed; NOW, THEREFORE, BE IT
  • RESOLVED, that Merle McKown residing at 27 Ellwood Ave., Cortland NY is hereby reappointed to the Cortland Housing Authority Board for a term beginning June 1, 2022 and expiring December 31, 2026.

Agenda Item #6 - Authorize Agreement to Supersede Previously Approved Option Agreement to Evaluate Feasibility of a Solar Energy Production Facility at 136 South Pendleton Street

  • WHEREAS, the Council approved a resolution on April 6, 2021 authorizing the Mayor to execute an Option to Lease Agreement with Davis Hill Development, LLC to evaluate the feasibility of a solar electricity generation facility at the City’s Rosen Property site; AND
  • WHEREAS, the approved authority did not allow for any terms of an actual lease beyond the evaluation process; AND
  • WHEREAS, the Davis Hill Development, LLC desires to extend their option to lease for a period of six (6) months to continue to evaluate the feasibility of a solar project at that site; AND
  • WHEREAS, it was intended that any extension be limited to the evaluation process in scope, as to not confer any landlord/tenant relationship between the City and Davis Hill Development, LLC; AND
  • WHEREAS, any agreement relative to the evaluation process shall be limited in scope, as to not confer any actual or perceived landlord/tenant relationship between the City and Davis Hill Development, LLC; NOW, THEREFORE, BE IT
  • RESOLVED, that the Mayor is hereby authorized to enter into an Option Agreement on behalf of the City of Cortland with Davis Hill Development, LLC for a period of six (6) months, in exchange for an extension fee in the amount of $250.00 to allow for the continuation of evaluating the feasibility of a solar energy production site at 136 South Pendleton Street; AND BE IT FURTHER
  • RESOLVED, that this agreement shall supersede any previously executed agreement between the City of Cortland and Davis Hill Development, LLC, whereby making the terms of any such previously executed agreement null, void, and unenforceable; AND BE IT FURTHER
  • RESOLVED, that this agreement shall not constitute a lease agreement between the parties and does not confer any landlord/tenant relationship between the City of Cortland and Davis Hill Development, LLC, and any future extensions shall require an additional agreement subject to Council approval.

Agenda Item #7 - Authorize Administrative Contract for 2021 New York Main Street Anchor Grant

  • WHEREAS, the City of Cortland was awarded a 2021 New York Main Street Anchor Grant (“Grant”) in the amount of $500,000.00 relative to the Keator Block rehabilitation project, and for administrative and program delivery services; AND
  • WHEREAS, the City of Cortland has entered into an agreement (“Grant Agreement”), which governs the administration of the Grant, with the New York State Office of Community Renewal; AND
  • WHEREAS, the Grant Agreement and/or regulations of the Grant require grantees to issue a Request for Proposals (“RFP”) for administrative and program delivery services of the Grant if not administered by the municipality; AND
  • WHEREAS, the City has chosen to use a third party to administer the Grant and, accordingly, issued said RFP receiving one response from Thoma Development Consultants (“Consultant”); AND
  • WHEREAS, the City has reviewed the Consultant’s response and has determined that it is acceptable, meeting all of the qualifications for administration and delivery of said Grant; NOW, THEREFORE, BE IT
  • RESOLVED, that the City authorizes the Mayor to enter into a contract with Thoma Development Consultants to administer the City’s 2021 New York Main Street Anchor Grant, pending formal approval from the New York State Office of Community Renewal.
