STATE OF NEW YORK PUBLIC SERVICE COMMISSION CASE 23-E-0412 PETITION OF HOMER SOLAR ENERGY CENTER, LLC, FOR CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY PURSUANT TO SECTION 68 OF THE PUBLIC SERVICE LAW, AND ORDER FOR EXPEDITED PROCEEDING

On July 28, 2023, Homer Solar Energy Center, LLC (“Petitioner”), submitted a Petition to the New York State Public Service Commission for a Certificate of Public Convenience and Necessity under Section 68 of the Public Service Law. The Petitioner is requesting an Order to authorize the entity, Homer Solar Energy Center, LLC, to construct, own, and operate the Homer Solar Energy Center (“Facility”), an approximately 90 megawatt (MW) major solar powered electric generation facility, to be located in the Towns of Homer, Cortlandville, and Solon, Cortland County, New York. The Petitioner also seeks an order granting an expedited proceeding. On July 22, 2021, the Petitioner submitted an application for a major renewable energy facility (“Application”) to the State of New York Office of Renewable Energy Siting (“ORES”) pursuant to New York State Executive Law §94-c (“Section 94-c” or “94-c”).1 On April 1, 2022, ORES determined that the Application, together with the Application Supplements and additional information filed on November 18, 2021, November 23, 2021, February 16, 2022, March 15, 2022 and March 18, 2022, was complete and in compliance with Section 94-c(5)(b) and 19 NYCRR §§ 900-4.1(c) and (g). On September May 31, 2022, ORES published a Draft Permit, and then on January 9, 2023, Petitioner was issued its Siting Permit for the construction of the Facility.

The Petitioner has requested no hearing be required and that the petition for a Certificate of Public Convenience and Necessity be determined on the basis of the Petition, attachments thereto, and the material provided to ORES, Matter No. 21-00976.

Any person seeking to comment on the Petition for a Certificate of Public Convenience and Necessity should notify in writing, within 10 days of the date of the publication of this Notice, the Secretary of the Public Service Commission at Agency Building 3, Empire State Plaza, Albany, NY 12223, of the reasons for the opposition.
