Agenda Item #1 - Amend the 2023 Adopted Budget by $7,500 to Recognize Revenues Not Appropriated in the Original Budget

WHEREAS, the Cortland Common Council is charged by the City Charter and Code with the preparation of an annual budget for the City of Cortland; AND

WHEREAS, on December 20, 2022, the Common Council adopted the City Budget for 2023; AND

WHEREAS, during the course of the fiscal year certain events occur that necessitate changing the budget plan by increasing or decreasing the total budget; AND

WHEREAS, the Department of Administration and Finance recommends the following adjustments to the budget; AND

WHEREAS, this resolution amends the City’s 2023 Adopted budget by $7,500 with appropriations to Code and Police; AND

WHEREAS, the Code Department has various projects that require additional inspection services procured via contract and these services are paid by the developer with an anticipated expenditure of $4,000 for the remainder of 2023 to be expended via A3620-541505; AND

WHEREAS, the Police Department sold a vehicle in the amount of $3,500 and requests to appropriate the sale of equipment revenue and the associated expenditure in A3120-520600; NOW, THEREFORE, BE IT

RESOLVED, that the City of Cortland Common Council does hereby amend the 2023 Adopted Budget in the amount of $7,500 as outlined in the accompanying table.

Agenda Item #2 - Authorize City Parking Citation Fines and Fees

WHEREAS, the Common Council adopted Local Law No. 13 of 2023 amending Section 11-61 b WHICH PROVIDES THE Common Council the authority to regulate parking enforcement including levying of fines pursuant to resolution; AND

WHEREAS, on September 19, 2023 the Common Council approved Resolution No. 159 of 2023 prohibiting parking of vehicles in municipal parking lots between 3:00 a.m. and 6:00 a.m. with the exception of specific signed area within the municipal parking lot designated for Residential Permits; AND

WHEREAS, the Common Council wishes to apply the same citation fines for parking without a valid Residential Permit in municipal lots between the hours of 3:00 a.m. and 6:00 a.m. as are currently in effect for parking on City streets between the hours of 3:00 a.m. and 6:00 a.m.; NOW, THEREFORE, BE IT

RESOLVED, that the City of Cortland Common Council hereby authorizes a citation fine of $35.00 for those in violation of parking in municipal lots without a valid Residential Permit between 3:00AM and 6:00AM, with an escalation to $40.00 if unpaid in 7 days and further escalation to $55.00 if unpaid in 30 days.

Agenda Item #3 - Designate Representatives to the Greater Tompkins County Municipal Health Insurance Consortium (GTCMHIC) Board of Directors

WHEREAS, the City of Cortland, having complied with all application requirements to become a Participant in the Greater Tompkins County Municipal Health Insurance Consortium (GTCMHIC) and has been accepted as a Participant; AND

WHEREAS, in order to activate membership the City of Cortland must provide additional information to complete and maintain its membership in the GTCMHIC; NOW, THEREFORE, BE IT

RESOLVED, that the following individuals are hereby designated to serve as the Delegate and Alternate to the Greater Tompkins County Municipal Health Insurance Consortium (GTCMHIC) Board of Directors: Lisa M. Henty (Delegate) and Mayor Scott Steve (Alternate); AND BE IT FURTHER

RESOLVED, that Krissie Brown is hereby designated to serve as a member to Joint Committee on Plan Structure and Design Membership and Appeals and Claims (member), as seats become available and appointments are confirmed.

Agenda Item #4 - Approval of the 2023 and Future Amendments to the Municipal Cooperative Agreement for the Greater Tompkins County Municipal Health Insurance Consortium (GTCMHIC)

WHEREAS, the City of Cortland (municipality), as a member of Greater Tompkins County Municipal Health Insurance Consortium (GTCMHIC), must approve any changes to the GTCMHIC Municipal Cooperative Agreement (MCA) by resolution; AND

WHEREAS, GTCMHIC must amend the MCA annually when any new members are approved at the Annual Board of Directors meeting; AND

WHEREAS, from time-to-time other changes are made to the MCA as necessary and when changes are made, they are reported at the Annual Meeting with membership approval; NOW, THEREFORE, BE IT

RESOLVED, until rescinded by resolution, the City of Cortland’s current presiding elected official is approved to sign, without further action, any Greater Tompkins County Municipal Health Insurance Consortium (GTCMHIC) Municipal Cooperative Agreement (MCA) updates that have been advanced at the GTCMHIC Board of Directors meetings and approved by the Department of Financial Services; AND BE IT FURTHER

RESOLVED, the GTCMHIC is directed to keep this resolution on file to accompany any current presiding elected official signatures to amended MCA changes.

Agenda Item #5 - Approve Special Event Permits and Sound Device Permitsfor the YMCA 5K Run Events on October 14, 2023 and November 23, 2023

WHEREAS, the YMCA of Cortland has submitted a Special Event Permit application for the purposes of holding the 5K Run events on from 10:00 a.m. to 1:00 p.m. on October 14, 2023 and 8:00 a.m. to 1:00 p.m. on November 23, 2023; AND

WHEREAS, the organizer has submitted a Sound Device Permit application for a fixed-location speaker and microphone to be used during each event; AND

WHEREAS, the Police Department, Fire Department, Department of Public Works, Youth Bureau and City Clerk’s Office have reviewed applicable aspects of these permit applications and recommended their approval; NOW, THEREFORE, BE IT

RESOLVED, that the City of Cortland Common Council does hereby approve for issuance by the City Clerk Special Event Permits and Sound Device Permits without fee for the 5K Run events on from 10:00 a.m. to 1:00 p.m. on October 14, 2023 and 8:00 a.m. to 1:00 p.m. on November 23, 2023.

Agenda Item #6 - Confirm Mayor’s Appointment of Margaret Jewett to the Environmental Advisory Committee

WHEREAS, §10-3 of the City Administrative Code provides that the Environmental Advisory Committee shall consist of seven (7) regular members appointed by the Mayor, with confirmation by the Common Council; AND

WHEREAS, a vacancy exists on the Environmental Advisory Committee; AND

WHEREAS, Mayor Steve has appointed Margaret Jewett to the Environmental Advisory Committee; NOW, THEREFORE, BE IT

RESOLVED, that the Common Council does hereby confirm Mayor Steve’s appointment of Margaret Jewett to the Environmental Advisory Committee for the remainder of the vacant term expiring December 31, 2023.

Agenda Item #7 - Authorize the Mayor to Enter into an Agreement with C&S Companies for Noss Industrial Park Site (ERP Site E712011) Remediation Services

WHEREAS, the City of Cortland is committed to implementing measures that will repurpose the Noss Park Industrial Site for active recreational use; AND

WHEREAS, the City of Cortland has the desire to restore the site to its pre-disposal conditions, eliminate or mitigate all significant threats to public health and the environment; AND

WHEREAS, in this process the City is obligated to update the Remedial Design Work Plan (RDWP) and cost estimates per New York State Department of Environmental Conservation (NYSDEC) regulations; AND

WHEREAS, the City of Cortland has selected C&S Companies to provide services for the remediation of the Noss Industrial Park Site including updating of the Remedial Design Work Plan (RDWP) and cost estimates, preliminary design, contract documents, bidding assistance, construction oversight, reporting and project closure for a lump sum fee of $7,500; NOW, THEREFORE, BE IT

RESOLVED, that the City of Cortland Common Council authorizes Mayor Scott Steve to enter in an agreement with C&S Companies for professional services relating to remediation of the Noss Industrial Park Site including updating of the Remedial Design Work Plan (RDWP) and cost estimates, preliminary design, contract documents, bidding assistance, construction oversight, reporting and project closure for a total fee of $7,500.00
